These Terms of Service (the “Terms”) govern your access to and use of the services provided by Ascendia Insurance LLC, operated by Juan C. Martinez, Licensed Insurance Broker. By using our services, you (“you” or the “Customer”) agree to be bound by these Terms.

1. Acceptance of Terms

By (a) clicking a box indicating acceptance of these Terms, (b) signing a related order form or agreement referencing these Terms, or (c) otherwise using Ascendia Insurance LLC’s services, you acknowledge that you have read, understood, and agreed to these Terms.

2. Definitions

“Services” means the insurance brokerage services provided by Ascendia Insurance LLC, including consultation, needs assessment, policy quoting, recommendations, and placement.

“Customer” means the individual or entity engaging with Ascendia Insurance LLC and/or Juan C. Martinez for insurance services.

3. Licensing and Authorization

Juan C. Martinez is a licensed insurance broker authorized to provide recommendations, facilitate insurance applications, and place policies with licensed insurance carriers. Services are provided in compliance with applicable laws and licensing regulations.

4. Scope of Services

Ascendia Insurance LLC provides:

Evaluation of your insurance needs.

Comparison and recommendation of products from financially sound, licensed carriers.

Assistance with applications and policy placement.

Ongoing support and guidance for issued policies.

Note: Ascendia Insurance LLC and Juan C. Martinez do not issue insurance policies directly. All policies are issued by third-party insurance carriers.

5. Customer Responsibilities

By using our Services, you agree to:

Provide accurate, current, and complete information.

Promptly notify Ascendia Insurance LLC of any changes relevant to your insurance needs or coverage.

Only use our Services for lawful purposes.

6. Fees and Compensation

Ascendia Insurance LLC is typically compensated by commissions paid directly from insurance carriers upon successful policy issuance. If any fees are due from you (such as consultation fees), they will be disclosed and agreed upon in writing prior to service.

7. Privacy and Confidentiality

We respect your privacy. All information collected is handled in accordance with our [Privacy Policy]. Personal information will not be disclosed without your consent, except as required by law or to complete services with insurance carriers.

8. Disclaimers and Limitation of Liability

Ascendia Insurance LLC and Juan C. Martinez provide services on an “as is” basis, without warranties of any kind.

Insurance products are provided by third-party carriers, and we make no guarantees regarding policy approval, underwriting outcomes, or coverage availability.

To the fullest extent permitted by law, Ascendia Insurance LLC’s liability (including that of Juan C. Martinez) shall be limited to the lesser of: (a) the total compensation received by Ascendia Insurance LLC from carriers in connection with your policy, or (b) $1,000.

9. Termination of Services

Ascendia Insurance LLC may suspend or terminate Services at any time for violation of these Terms or other valid reasons.

You may terminate Services at any time by notifying us in writing.

Termination does not relieve you of obligations incurred prior to the date of termination.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the state in which Juan C. Martinez is licensed and primarily conducts business. Any disputes will be resolved in the courts of that jurisdiction.

11. Changes to Terms

Ascendia Insurance LLC reserves the right to update these Terms at any time. The most current version will always be posted with a new “Last Updated” date. Continued use of our Services constitutes acceptance of any changes.
